GENERAL TERMS AND CONDITIONS

Entering your personal details implies that you accept the following legal clause.

 

1. OBJECT

These general terms of sales (hereinafter "General Terms of Sale") regulate the online sale of products offered to the public by LABORATORIOS SUAVINEX S.A.U. (hereinafter, "the Seller") through the online shop with the URL shop.suavinex.com (hereinafter "the Website").

All sales that are made are distance sales regulated by the applicable Spanish legislation.

 

2. COMPLIANCE WITH THE GENERAL TERMS AND CONDITIONS

Completing and sending the purchase order implies full, unreserved compliance with each and every one of the General Terms of Sale, as explicitly stated in the Purchase Order.

 

3. SCOPE OF APPLICATION

The Website is currently in operation in the Spanish Mainland and Balearic Islands.

 

4. ORDERS

The Purchase Orders referred to in these General Terms and Conditions are those passed on to the Seller by electronic means through the online shop on the Website. To ensure that a purchase order placed through the Website is valid it is necessary to complete all the information requested on the forms provided on the Website.

We inform you that the Purchase Order and the Customer Registration process record the IP addresses of the internet connection from which they are carried out. We may use the IP address as legal evidence in possible cases of fraud due to misuse of credit cards and/or false orders.

 

5. PRICE

All the prices stated on this Website include VAT at the rate applicable at the time of the sale.

 

6. METHODS OF PAYMENT

Payment may be made by credit / debit card. This method of payment is immediate and is completely secure. The Seller accepts no liability with regard to the confidentiality and security of the information and data provided by the Customer when making electronic payment transactions by credit card, insofar as the processing of this information and data is not exclusively under the Seller's control.

If the Customer asks the bank to cancel payment of a purchase that has been made, he/she must compensate the Seller for any damages caused by this cancellation of payment.

The Seller accepts no liability, even indirectly or secondarily, for any kind of damages deriving from the access, maintenance, use, quality, legality, reliability and use of contents, information, communications, opinions, statements, products and services that appear or are offered on its Website and which are not managed by the Seller itself.

 

7. DELIVERY OF THE PRODUCT

The product will be delivered to the pharmacy provided once the purchase has been made. The Customer undertakes to provide the Seller with correct, intelligible delivery details.

The delivery time for products that are IN STOCK is 48-72 hours after the order is placed.

Delivery times: 48/72 hours.

The exact cost will be stated before you place your order.

If the product is not available, it should always be understood that the delivery time counts from the moment the goods arrive at our warehouse and the order is dispatched. The Seller takes no responsibility if it is impossible to provide the service due to force majeure or accidental circumstances. If the product is delayed due to problems outside the Seller's control (discontinued product, stock broken by manufacturer, etc.), the Seller's customer care services will contact the Customer to arrange the best solution so that the order can be dispatched.

The Customer will also be informed of the status of the order each week if it is delayed beyond a reasonable period.

Customers who have registered on the Website can check the status of their order in their private area.

The Customer will receive an e-mail from the transport company stating the tracking number of the order according to the conditions specified by that company.

For the purposes of counting delivery days Friday afternoons, Saturdays, Sundays and public holidays (both national and local) do not count.

 

8. RESPONSIBILITY FOR DELIVERY

In the following cases, the Seller is exempt from complying with the established delivery conditions and takes no liability for the situation:

             If the Customer fails to pay for all or part of the Purchase Order.

             If the information provided by the Customer in the Purchase Order when placing the order, as established in these General Terms and Conditions, is incomplete or inaccurate.

 

9. RETURNS

If, for any reason, the Customer is not satisfied with the order, it may be returned within 15 working days of the date of delivery of the order. (According to Art. 44 of Law 7/1996, of 15 January, on Retail Commerce, amended by Law 47/2002, of 19 December).

If the Customer wishes to return a product, it must be in perfect condition, unused and in its original packaging (returned products that are not in their original packaging will not be accepted), together with all the product documentation. Personalised products and "special" collections products may not be returned. If the product meets these requirements, the Customer must send an e-mail to suavinex@suavinex.com or call (+34) 902102292 so that the Seller can authorise and process the return and explain the returns procedure. If authorisation is not obtained, the product will not be accepted and will be returned to the sender.

Once the goods have been received at the Seller's warehouse and it has been verified that they fulfil all the aforementioned conditions, the Seller will accept the returned product and refund the purchase price to the credit/debit card that was used or by bank transfer to the designated account, for which the Customer must be the account holder.

All products offered by the Seller are covered by the legally applicable manufacturing guarantee. However, the guarantee does not cover products that have been damaged by external factors, accidents, etc. or by mishandling or improper use after delivery to the Customer.

The Seller does not offer any guarantee for products or services that have been sold by third parties.

If the product received is faulty, the Customer must also contact the Seller stating this. After verifying that it fulfils the required conditions for accepting its return, a replacement product will be sent, which will be delivered within 24/48 hours of it being dispatched from the warehouse (if it is not in stock at that time, it will be sent out as soon as it arrives at the Seller's warehouse).

IN ALL CASES, if the product is to be returned or exchanged as the result of a mistake when the order was prepared by the Seller's online sales service or if the product is faulty, all the delivery costs will be met by the Seller.  Otherwise, the transport costs must be paid by the Customer. If the goods reach the Seller's warehouse with damaged packaging or seals other than those used by the Seller, the cost of repackaging the product must be paid by the Customer.

 

10. LIMITATION AND EXCLUSION OF GUARANTEES AND LIABILITY

The Seller does everything in its power to ensure that the Website suavinex.com works properly and it only takes liability for damage suffered by Users as a result of using the Website when said damage is attributable to wilful misconduct on the Seller's part. Users recognise and accept that both use of the Website and purchase of the products offered on it are entirely at their own risk and under their own responsibility.

The Seller accepts no liability deriving from:

a) The information published on its Website, provided that this information has been manipulated or inserted by a third party outside the organisation. Any damages caused by third parties due to illegal interference that is outside the control of the Website and not attributable to the Seller.

b) Errors in access to the Website and interferences, omissions, interruptions, computer viruses, technical problems and/or disconnections affecting the operation of this electronic system or Users' computer equipment for reasons not related to the Seller that prevent or delay use of the services offered or browsing of the system.

c) Problems affecting the availability or continuity of the Website and the services provided on it.

d) Delays or blockages in its use caused by faults or overloads of the Internet or other electronic systems.

e) Technical faults or errors in the prices or any other information obtained through the Website or any differences in the information, documentation and/or other content provided on the Website between the electronic version and the printed version of it.

f) The Seller accepts no liability for damages of any kind due to lack of accuracy, thoroughness or current applicability or due to errors or omissions in the information and services contained on this Website as a result of failures or errors in the technical media where they are stored.

g) If the Website hosts banners that allow the user to access Websites or links owned by third parties. In this case, the Seller accepts no liability for the contents found on them and will remove them if Users report illegal content, once such content has been verified.

h) The Seller may temporarily suspend the services of its Website, at any time and without giving the User prior notice, due to technical problems or force majeure.

i) The Seller does not generally control the use made of the Website by its Users. In particular, it does not guarantee, under any circumstances, that Users use the service in accordance with the Law, these General Terms and Conditions, morality and generally accepted good practices and public order, nor that they use it in a diligent, sensible manner.
